Notice and Take-Down Procedure
We operate a Notice and Take-Down Procedure to address reports of content that may be defamatory, infringing, or otherwise illegal.
1. Submitting a Notice
If you believe content hosted on our servers is illegal or infringes your rights, please send a written notice to our designated contact at support@firepixel.com including the following details:
- Your full name, organization (if applicable), and contact information
- A clear description or URL of the specific content in question
- The legal or factual basis for your complaint (e.g., copyright infringement, defamation, court order, etc.)
- Supporting evidence, if available
- A good-faith statement that the information in your notice is accurate and that you are authorized to act on behalf of the rights holder
Incomplete notices may not be processed.
2. Review and Preliminary Action
Upon receiving a valid notice, we will review the report to determine whether the content appears to violate applicable laws or our Terms of Service.
If the notice appears credible, we may temporarily restrict or disable access to the content while the matter is investigated.
The website owner or account holder responsible for the content will be notified and given the opportunity to respond.
3. Counter-Notice Process
If you are the website owner or uploader of the affected content and believe the takedown is in error, you may submit a counter-notice to support@firepixel.com including:
- Your full name and contact details
- The specific content or URL that was removed
- A statement, made under penalty of perjury, that you believe the content was removed in error or misidentification
- Your consent to the jurisdiction of the courts in your location (or where Fire Pixel, Inc. is based)
We may restore the content within 10–14 business days if no legal action is initiated by the complainant.
4. Repeat Violations
Accounts or domains found to repeatedly post unlawful or infringing content may be suspended or terminated in accordance with our Terms of Service.
5. Recordkeeping
We maintain records of all notices, counter-notices, and actions taken under this policy for compliance and legal reference.
6. Legal Disclaimer
Fire Pixel, Inc. is a hosting service provider and does not actively monitor or edit customer content. We act in good faith upon receipt of valid notices and are not liable for user-generated materials stored on our systems.
